PVC Roofs in Kensington, MD

In Kensington the flat roofs worth a PVC conversation mostly cover rented homes: the Census puts 300 of 442 renter households in buildings of 50 or more units. The Town Code gives those roofs to an owner to maintain, and never names a roof or a membrane.

Straight answer first

Is there anything about PVC that is specific to Kensington?

No. No Kensington document we read treats PVC differently from any other covering. What neutral sources do support is general: the model building code lists PVC among the single-ply membranes, and single-ply roofs share the code's rules on slope, drainage and edges. The flat roof guide covers them.

Our reading

The roof matters less than the owner

On a house the payer and the resident are one person. On a 50-unit building they are not, so the calls below start with the owner.

Who sits under the big roofs

How are Kensington's renters and owners spread across building sizes?

Census Bureau, American Community Survey 2024 5-year estimates, table B25032, Town of Kensington. Our cut of the table; the margins are wide at this size.

HouseholdsEstimateMargin of error
Owner-occupied, detached or attached house451 of 451plus or minus 42
Renter-occupied, buildings of 3 to 49 units105wide for each size band
Renter-occupied, buildings of 50 or more units300plus or minus 131

The survey estimates no owner-occupied households in any building of two or more units. With margins this wide, that is a finding, not proof of a zero. Our reading: the people under multi-unit roofs here mostly rent, so the roof decision sits with a landlord or manager.

The order of calls

When a flat roof over rented homes needs work, whose move is it?

  1. First: the owner or manager of the building

Section 5-202 of the Town Code says residential and non-residential structures shall be maintained by the owner and occupant in good condition. It does not divide the duty between the two.

Stop here if you own the single house under the roof
  2. Second: the housing maintenance standards the Town adopted

Section 5-201 adopts Montgomery County Chapter 26, Housing and Building Maintenance Standards, which lets county officials inspect dwellings; the county and the Town may both enforce it. The chapter's own text is a question for those offices.

  3. Third: the tenant side of the relationship

Section 5-501 adopts county Chapter 29, Landlord-Tenant Relations, and Section 5-502 adds the county's tenant displacement and condominium chapters. A tenant with a leak starts here.

  4. Fourth: the permit and district questions

Once an owner will act, the Town-first permit order on the Kensington page applies, with the county's historic review if the parcel lies in the district.

Said and unsaid

What the Town's maintenance sections cover, and what they leave out

Section 5-202 lists three conditions to keep structures free of: rust, graffiti and broken glass. Flaking paint or bare wood may not cover more than 10 percent of a structure's surface. A violation is a Class D infraction for commercial properties and Class E for residential ones, and the owner has 30 days to comply before an infraction issues.

The word roof does not appear in that section, and neither does any covering. Whether a roof falls under the general good-condition duty is a question for the Town.

  • SaidAn owner and occupant duty of good condition, with a 30 day window.
  • SaidCounty housing and landlord-tenant chapters adopted by reference.
  • UnsaidAny roofing material, membrane or PVC.
  • UnsaidWhether a same-material re-roof needs the Town building permit; the Kensington page covers that open question.

The district count

How many apartment and shop buildings did the preservation plan actually count?

The Vision of Kensington, the long-range preservation plan, counts 181 buildings in the historic district: 151 dwellings, 20 commercial buildings, five apartment buildings. Its zoning report lists 161 one-family, 20 general commercial, five low density apartment and one commercial transition properties.

Our reading: the Census counts the whole Town and the plan counts inside the district line, so the two cannot be laid over each other. A large rented building may or may not be one of the plan's five; the parcel decides, so ask the county Historic Preservation Office, 301-563-3400. The TPO page covers the plan's flat roof count and the metal page its roof survey.

Is PVC the candidate?

Before anyone proposes PVC for a Kensington building, what should be settled?

  • The roof must be flat or nearly flat

    Why
Single-ply membranes, PVC included, are low-slope coverings, and the model building code gives them a minimum design slope for drainage.
    Who to ask
The owner, from the roof, not the street.
  • Someone has to name what is on it now

    Why
Matching-material repair and a change of covering are treated differently if the parcel is in the district. A data sheet settles it better than a guess from the ground.
    Who to ask
    The owner or manager.
  • The choice rests on the building, not the town

    Why
No Kensington document separates PVC from TPO or EPDM, so the decision turns on the building's drains, edges and seams. See the materials comparison.
    Who to ask
The designer or a roofer who walks the roof.

FAQ

Rented roofs, the Town Code and PVC in Kensington

Does the Kensington Town Code mention roofs in its maintenance rule?

Not in Section 5-202. It names rust, graffiti, broken glass and peeling paint or bare wood over 10 percent of a surface, and sets a general good-condition duty.

Who is responsible for a flat roof over rented homes in the Town?

Section 5-202 puts maintenance on the owner and occupant without dividing it. County Chapter 29, adopted in Section 5-501, covers landlords and tenants; its text was not read for this page.

How many Kensington renters live in very large buildings?

The Census estimates 300 of 442 renter households are in buildings of 50 or more units, with a margin of plus or minus 131.

Is there a Kensington rule for PVC specifically?

None that we found. The Town Code, the district plan and the county roof guidelines read for these pages name no roofing membrane.

Is a 50-unit building automatically inside the historic district?

No. The Census counts by building size and the plan counts inside the district line. The parcel decides, so ask the county Historic Preservation Office.

How long does the Town give an owner to fix a maintenance violation?

Sections 5-201 and 5-202 each give 30 days to bring the property into compliance before a municipal infraction issues.
